What do you do if you find yourself charged with having committed a crime?  For most people this is a life-shattering event.  You need clear and competent legal counsel from the very outset.  Even if the crime is a state misdemeanor (a charge in the District Court, which carries a maximum penalty of 12 months or less), the consequenses of failing to obtain legal representation can be severe.  A criminal conviction remains on your record for the remainder of your life, unless expunged.  In some cases, a prior conviction can be used to enhance the penalty for a later conviction, should find your self charged again.

Your entitlement to counsel begins the moment you find you are the focus of a criminal investigation.  Early representation may make the difference between not being charged and having your life turned upside down by an arrest and even a trial.  Even if acquitted at trial, an individual's reputation can be irreparably damaged by an arrest and the publicity of the cirminal process.  Remember, you always have the right to consult with an attorney, though the police are only required to notify you of this right when you are being "detained".  When you are detained as opposed to merely being questioned is often a muddy issue.  You must be aware that any time an officer is asking you questions, there is a possibility that an inarticulate answer may lead to your arrest, even though you have not committed a criime.  Simply advise the officer that you wish to consult an attorney before answering his or her questions.  If you are not given the opportunity to do so, nothing you say can be used in any subsequent prosecution of the crime about which you are being questioned.
The law provides many tools to assist an individual charged with a crime.  The earlier you obtain legal representation, the more of those tool will be available to your attorney to protect your rights.  Waiting until just before trial will seriously handicap your defense and may make the difference between an acquital and going to jail.
