Divorce - No matter how amicable, divorce is still divorce and culminates in the physical disintegration of your family. The goal must be to make a bad situation as painless and healthy as possible for you and your children. We will assist you with all aspects of your divorce, from start to finish. That is, from filing all temporary (called pendant lite) motions, to final hearing and decree, to post-decree motions, if necessary.
Custody - There are two aspects to custody in Kentucky, legal custody and physical custody. Legal Custody means which parent will have the legal right to make important decisions regarding the children. Physical Custody means time sharing. Even if the parties share Joint Legal Custody, there may be serious issues regarding time sharing. No two families are the same and we will work for you to establish the best possible custody arrangement which best serves the interests of your children and protects your legal right.
Modification - Even after your divorce is final, difficult issues may arise, even years later, which will require the modification of a prior Order. These issues may effect matters such as spousal support (maintenance), child support, child custody, and visitation.
Adoption - Adoption is often the most enjoyable and satisfying part of our practice. We appreciate the opportunity to assist families wishing to take the important step of adopting a child. Adoptions typically occur between a biological parent or parents and a stepparent, grandparents and other family members. However, we also handle adoptions from the state agency (The Cabinet for Health and Family Services) and private adoption agencies. We would be happy to assist you in the formation of your new family.
Grandparent Rights - This area of Family Law is ever changing. Many may have heard that Kentucky's Grandparent visitation law was held to be unconstitutional. That is not exactly the case. In fact the law of a sister state was declared by the United States Supreme Court to be unconstitutional as it was being applied. That law was very similar to Kentucky's law. However, the Kentucky Courts have taken the position that a grandparent may still be entitled to visitation with a grandchild, if it is in the child's best interest. Primarily, the Courts must look at whether there is a pre-existing and beneficial relationship between the child and the grandparents. We will assess your situation and advise if we feel you have a case to obtain grandparent visitation. In certain other situations, grandparents may need to, and have standing to, seek custody of their grandchildren. We will assist you in this difficult endevor as well.
