I have been handling workers' compensation cases in Kentucky since 1991.  There have been drastic changes in this area of practice over the years.  The current system is much better for the worker than in recent years though, in my opinion, there is still much room for improvement. If you have suffered a work injury, the first thing you must remember is that it must be reported to your supervisor as soon as possible.  The failure to give notice of an injury may result in a loss of your benefits.  Make sure a report of the injury has been filed with the state. 

 

Once the injury is reported, the employer is responsible for your medical benefits associated with your injury and income benefits until you are able to return to work or a doctor has given the opinion that you have reached maximum medical improvement.

 

Following the injury, you have two years to file a claim for permanent disability benefits.  The failure to file a claim will result in a termination of your medical benefits after the two year period.
